Rate for the exclusive use of the charging point that includes a dedicated charger, maintenance and afixed amount of 160 kWh per month, not accumulative for the following month. When montlhy  threshold of kWh is exceeded, pay per use  is activated at the BAMSA customer price (€ 0.30 / kWh VAT included). For any consumption in public chargers, the pay-per-use rate scheme is applied with the price of € 0.30 / kWh in quick chargers and € 0.45 / kWh in fast chargers)

1. The Data Processing Managers in charge of your personal data

2. Purpose of processing personal data

 

Processing required for service provision

 

The data managers will process your personal data with the aim of managing the electric vehicle charging service provision. If this service involves instalment payments or periodic invoicing, prior to the contract being approved we may conduct credit and solvency checks as we deem appropriate to assess your financial solvency. The result of this consultation could, where appropriate, determine the entry into force of the Agreement. In the event of non-payment, Endesa X may also communicate your data to be used in these checks, in compliance with the guarantees granted by the current legislation.

 

As such, the Data Processing Managers will be able to process your personal data in order to comply with any legal obligation they may have and specifically those obligations related to the regulation of the energy market or commercial regulations, among others. 

 

Voluntary processing

 

Other processing of your personal data may also be undertaken that does not correspond to the need to perform an agreement or comply with a legal obligation, and to which you may object or not wish to give your consent.

 

As such, provided that you do not object, you may receive information about the following via any communication method (including but not limited to email, text message and telephone calls): 

 

• Products or services offered by Endesa X in the field of energy activity that may be of interest to you. To obtain this information, your personal data may be analysed in order to develop a profile that enables the commercial messages to best match your needs and preferences. This analysis may take into account your demographic data and also data regarding any of the company's other products you have purchased. In any event, you will only receive sales messages by non-digital means while you remain a customer of Endesa X.

 

• Products or services offered by SABA in the field of mobility that may be of interest to you. To obtain this information, your personal data may be analysed in order to develop a profile that enables the commercial messages to best match your needs and preferences. This analysis may take into account your demographic data and also data regarding any of the company's other products you have purchased. In any event, you will only receive sales messages by non-electronic means while you remain a customer of SABA.

 

In addition, provided that you have ticked the box to give your consent, you may receive information about the following via any communication method (including but not limited to email, text message and telephone calls): 

 

• Other products and services offered by Endesa X, SABA or third parties that are connected to the energy, equipment, home, insurance, automotive, mobility, financial services and leisure sectors. To obtain this information, your personal data may be analysed in order to develop a profile that enables the commercial messages to best match your needs and preferences. This analysis may take into account your demographic data and also data regarding any of the company's other products you have purchased. In any case, you will only receive commercial messages about products and services not related to those you have purchased, provided that you do not withdraw the consent provided.

 

Provided that you have given your consent, your geographic location will be processed in order to locate your nearest electric charging points. 

 

Managing app-based services

 

Where appropriate, your data will be processed in order for sign-in to be performed in the App. If you sign in using 'social login' using Google or Facebook, your username and password will be processed in order to perform registration in the App. 

 

In addition, once you have been registered, your data will be processed for the purpose of managing the user service(s) on the App.

 

Period for which personal data is retained

 

Clients' personal data will be retained for as long as necessary for the provision of the services included in the contractual relationship. As soon as it is no longer required for this purpose, the data will be blocked for the period during which it may be needed for use or defence in administrative or judicial procedures and may only be released and reprocessed for this purpose. Once this period has ended, the data will be permanently deleted.

 

Personal data used for voluntary processing will be processed until you inform us otherwise, either by using the option offered in digital communication that you may receive or by contacting the Data Processing Managers as explained in section 5. An exception will be made for data processed in order to send commercial communication via non-digital methods, which will be cancelled once the contractual relationship has come to an end.

 

3. Recipients of the personal data

 

Your personal data may be transferred to public agencies, authorities and government bodies, including courts and tribunals, when required by the applicable legislation.

 

Your personal data may also be accessed by the service providers that Endesa X or SABA hires or contracts that have the status of Data Processing Managers. In addition, some of these data processors may be located in the United States or outside the European Economic Area. 

 

Additionally, if you have specifically given your consent, your data may be given to companies belonging to the Endesa Group and to third party companies connected to energy, the home, insurance, automotive, financial services and leisure, so that they may contact you to inform you about products and services that these companies market. Your personal data may also be communicated to credit institutions with the necessary safeguards and for the sole purpose of carrying out factoring operations (partial or total advance credits assigned to financial institutions).

 

4. Legal basis for processing and transferring personal data

 

The legal basis for the purposes included in section 2 as "mandatory processing for service provision" will be the performance of an agreement or the fulfilment of applicable legal obligations, except for the processing carried out to assess financial solvency, the acceptance of clients or, where appropriate, communicate data to credit information systems, whose legal basis will be Endesa X 's legitimate interest. Therefore, refusal to supply the requested personal data, or the submission of inaccurate or incomplete data, could result in an inability to provide the purchased services correctly. The users are responsible for the veracity of the data provided, as well as for notifying Endesa X and SABA of any modification of this.

 

The legal basis for carrying out processing for the purpose of sending commercial messages about products or services offered by Endesa X in the area of the energy sector or about SABA products in the mobility sector, will be the legitimate interest Endesa X and SABA, respectively. For this reason, you may oppose this by sending an email to the email addressed provided in section 5. . You will find the information needed to exercise your right of opposition in Section 5 below, "Rights of users in relation to the processing of personal data.". 

 

Processing carried out for the purpose of sending commercial messages regarding other products or services offered by Endesa X , SABA or third parties relating to energy, equipment, the home, insurance, cars, mobility, financial services and leisure shall have the consent you have given as its legal basis. Therefore, unless your consent is withdrawn, you may continue to receive messages of this kind.

 

Transfer of your data to companies belonging to the Endesa Group and to third-party companies relating to the energy, equipment, home, insurance, automotive, mobility financial services and leisure sectors shall have the consent you have given as its legal basis. Therefore, unless your consent is withdrawn, you may continue to receive messages of this kind.

 

The transfer of data to credit institutions for the exclusive purpose of carrying out factoring operations (partial or total credit advances transferred to financial institutions) shall have the legitimate interest of Endesa X to have an efficient company management model as the legal basis.

 

The use of the services offered by Endesa X and SABA will never be conditional on you providing the requested consent. In any case, we remind you that if you have given your consent you have the right to withdraw it at any time without it having any consequence on the services or products you have purchased or of which you are the beneficiary. You will find the information needed to exercise your right to withdraw consent in Paragraph 5 below, "Rights of users in relation to the processing of personal data.".

 

5. Rights of users in relation to the processing of personal data

 

You will be able to exercise your rights of access, rectification, cancellation, limitation of processing and transferability of data as provided for by applicable regulation at any given time. 

 

You also have the right to withdraw consent if you have given it, and to object to receiving commercial messages.

 

In order to exercise these rights before Endesa X, you may use one of the following methods:

 

• By sending a written request by post, attaching a photocopy of your national identity card, passport or any other identification document to Apartado Postal (PO Box) 1128, 41080 – Sevilla, c/o: Endesa Operations and Commercial Services.

 

• By sending an email to solicitudeslopd@endesa.es with the following information: your first name and surname, address for the purposes of notifications, a photocopy of your national identity card, passport or other identity document, and your written request.

 

In order to exercise your rights before SABA, you may use one of the following methods:

 

• By sending a letter to SABA Avda. Parc Logístic, 22-26  08040 Barcelona, c/o: DPO.

• Sending an email to the following address: dpo.saba.es@saba.eu. 

 

You are also informed of your right to file a complaint with the Agencia Española de Protección de Datos (Spanish data protection agency).

 

6. Source of Data

 

The personal data subject to treatment by Endesa X and SABA are those provided by you for the procurement of the services referred to in this contract. Sometimes this data can be enriched with sources of specific information about the Spanish energy market.
